From 1 September 2024, Queensland’s new minimum housing standards will impact all rental properties (previously these changes only applied to new tenancies from 1 September 2023).
At Holt Ronan Lawyers, we are here to guide property owners, landlords and property managers through these changes. Here’s what you need to know from a legal perspective:
Key Changes to Housing Standards
- Safety and Security: Properties must have functional smoke alarms, secure window locks, and safe entry points.
- Ventilation and Light: Ensure habitable rooms have adequate ventilation and natural light.
- Heating and Cooling: Proper heating and cooling systems are required for tenant comfort, the property must be weatherproof and structurally sound.
- Electrical Safety: All electrical installations must meet strict safety standards.
- Structural Integrity: Address significant defects and maintain the property in good repair.
Legal Implications for Landlords
- Compliance Deadline: Ensure your property meets the new standards by 1 September 2024 to avoid penalties. If its not compliant by then these standards are considered "emergency repairs".
- Ongoing Obligations: Regular maintenance and adherence to standards are mandatory throughout the tenancy.
- Record-Keeping: Maintain detailed records of inspections, repairs, and compliance efforts.
- Tenants can terminate: Or apply to QCAT for orders to rectify the defects.
